This Privacy Policy applies specifically to mobile numbers enrolled in our SCADA (Supervisory Control and Data Acquisition) SMS alert notification service powered by Twilio. It governs the collection, use, and protection of information related to these operational alerts only.
1. Purpose and Scope
Valor Energy Services provides SCADA SMS Alert Services to deliver automated text message notifications for industrial automation, control systems, oilfield equipment, and related infrastructure. These alerts notify authorized personnel of critical events such as alarms, faults, threshold violations, equipment status changes, and other operational conditions.
Important: This service and this Privacy Policy are strictly for operational SCADA use only. This number and messaging service are not used for business notifications, marketing, promotional messages, sales outreach, or general business communications.
2. Information We Collect
We collect the following information solely for the purpose of delivering SCADA SMS alerts:
- Mobile phone numbers of authorized recipients (operators, technicians, engineers, clients, or designated personnel)
- Associated configuration data, such as site/facility identifiers, equipment tags, alert severity preferences, and escalation rules
- Basic consent records confirming the number was provided for SCADA alert purposes
We do not collect or store unnecessary personal data beyond what is required to configure and deliver these alerts reliably.
3. How We Use Your Mobile Number and Information
Your mobile number is used exclusively to send automated, event-driven SMS messages triggered by your organization's SCADA system configuration. Messages are sent only when specific conditions, alarms, or events occur in the monitored systems.
We do not use your mobile number or data for any other purpose, including marketing, advertising, newsletters, account promotions, or unrelated business communications.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Mobile opt-in data, SMS consent, and any information collected solely in connection with enrollment in SCADA SMS communications will not be sold, shared, or disclosed to third parties or affiliates for marketing or promotional purposes. This data is excluded from any data sharing described in any other privacy policies of Valor Energy Services.
4. Message Frequency
Message frequency varies and is determined entirely by events occurring in the SCADA system(s).
- Messages are event-driven and asynchronous — not sent on any fixed schedule, daily/weekly cadence, or recurring basis.
- During normal operations, recipients may receive zero or very few messages.
- During incidents, upsets, maintenance windows, or periods of abnormal equipment behavior, multiple messages may be sent in a short time frame as conditions evolve.
- There are no marketing messages, promotional texts, or unsolicited communications of any kind.
Frequency is controlled by the SCADA system configuration set by authorized administrators for each site or asset.
5. Message and Data Rates May Apply
Message and data rates may apply. Standard messaging rates and any applicable data charges from your mobile carrier will apply to messages received. Please check with your wireless provider for details about your specific plan.
6. Opt-Out Instructions
You may stop receiving SCADA SMS alerts at any time:
- Reply STOP to any message received from the SCADA alert system. This is the fastest method.
- Contact us at team@valor.energy or your designated SCADA/automation support contact and request removal of your number.
We process STOP requests promptly (typically within minutes to a few hours, subject to carrier processing). After opting out, you will cease receiving messages unless you are re-enrolled by an administrator with your renewed consent.
Reply HELP to any message for assistance or to receive contact information.
7. Consent and How Numbers Are Added
Consent is obtained prior to enrollment. Authorized personnel (system owners, operations managers, or designated contacts) provide mobile numbers directly to our SCADA team or through secure system configuration tools when setting up or updating alert notification lists for specific sites, equipment, or processes.
By providing or confirming a mobile number for SCADA alerts, the individual and/or their organization consents to receive these operational text messages. This consent is limited to SCADA operational alerts and does not authorize any other type of messaging.
8. Data Security and Retention
We implement reasonable administrative, technical, and physical safeguards to protect mobile numbers and associated alert configuration data from unauthorized access, use, or disclosure. Data is stored securely and accessed only by personnel with a legitimate need to manage the SCADA alerting service.
Mobile numbers and consent records are retained only for as long as the number remains enrolled in active alert configurations or as required for legal, safety, or operational record-keeping purposes. You may request deletion of your information by contacting us.
9. Changes to This Policy
We may update this Privacy Policy periodically to reflect changes in our practices, legal requirements, or service offerings. The "Last Updated" date above indicates the most recent revision. Continued use of the SCADA SMS alert service after updates constitutes acceptance of the revised policy.

These Terms and Conditions ("Terms") govern the SCADA SMS Alert Service (the "Service") provided by Valor Energy Services to its clients ("Client" or "Customer") and the individual recipients ("Recipient," "You," or "Your") who receive SMS notifications.
Important Notice: This Service is provided strictly for operational SCADA and industrial automation alerts. It is not a marketing, promotional, or general business notification service. Messages are sent only in connection with SCADA system events for sites and equipment operated or monitored under a services agreement between Valor Energy Services and the Client.
1. Acceptance of Terms
By providing your mobile number to be enrolled in the Service, or by continuing to receive messages from the Service, you acknowledge that you have read, understood, and agree to these Terms and the associated Privacy Policy for SCADA SMS Alert Services. If you do not agree, do not provide your number and reply STOP to any message received.
2. Description of the Service
The Service delivers automated SMS text message notifications triggered by events, alarms, faults, status changes, and other conditions detected by SCADA, PLC, RTU, or other industrial control and automation systems. These notifications are configured by or on behalf of the Client for operational awareness and response.
Messages may include, but are not limited to: alarm descriptions, site/equipment identifiers, timestamps, severity levels, and basic instructions or contact references. All messages clearly identify the sender as Valor Energy Services or the specific Client site/system.
3. Relationship to Employment / Authorization with the Client
The Service is provided by Valor Energy Services to the Client under a separate services agreement. Individual Recipients are employees, contractors, or other authorized personnel of the Client (or entities working under the Client's direction at the monitored sites).
Your eligibility to receive alerts is granted by the Client based on your role, responsibilities, and employment or contractual relationship with the Client. The Client (not Valor) controls which numbers are added to or removed from alert distribution lists.
Upon termination of your employment, engagement, or change in role with the Client, it is the Client's responsibility to remove your mobile number from active alert lists. You should notify your supervisor or the Client's designated SCADA/automation administrator if you no longer wish to receive alerts.
4. Consent and Enrollment
Consent for enrollment is obtained through the Client's authorized representatives or administrators. By providing or confirming your mobile number for SCADA alerts, you consent to receive these operational notifications while you remain an authorized Recipient under the Client's direction.
This consent is specific to operational SCADA alerts and does not authorize any marketing or non-operational communications.
5. Message Frequency and Content
Message frequency is variable and event-driven only. You will receive messages solely when conditions configured in the SCADA system occur. There are no scheduled, recurring, or promotional messages.

6. Opt-Out
You may opt out of receiving further messages at any time by:
- Replying STOP to any SMS message from the Service, or
- Contacting your employer (the Client) or Valor Energy Services at team@valor.energy.
Opting out via STOP will stop messages to your number. Note that the Client may still maintain your number in their internal records for other operational purposes unless you also request removal directly from the Client.

7. Client Responsibilities
The Client is responsible for:
- Ensuring that only properly authorized personnel (based on employment or contractual relationship) are enrolled in alert lists.
- Maintaining accurate and up-to-date recipient lists, including timely removal upon role changes or termination.
- Ensuring that enrollment complies with applicable employment policies, privacy laws, and any internal consent requirements.
- Defining appropriate alert thresholds, escalation paths, and response procedures that complement (but do not replace) the Client's safety management system.
8. Recipient Responsibilities
As a Recipient, you agree to:
- Provide accurate contact information and notify the Client promptly of any changes to your mobile number.
- Treat alert messages as operational information only and follow your employer's established procedures for responding to alarms and notifications.
- Not forward, share, or misuse alert content in a manner that could compromise site security or operations.
- Understand that these messages are supplementary notifications and do not replace direct monitoring of SCADA HMIs, on-site presence, or other required safety protocols.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
The SCADA SMS Alert Service is a supplementary notification tool only. It is not intended to be, and should never be relied upon as, the sole or primary means of detecting, responding to, or mitigating equipment issues, safety incidents, environmental releases, or operational upsets.
Valor Energy Services, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business interruption, personal injury, property damage, or any other losses arising out of or related to:
- Delayed, failed, incomplete, or inaccurate delivery of SMS messages (due to network issues, carrier filtering, device settings, power/internet outages at sites, or any other cause);
- Actions taken or not taken by you or any third party in response to an alert message;
- The Client's configuration of alert thresholds, content, or distribution lists;
- Any failure of the underlying SCADA, PLC, instrumentation, or communication infrastructure;
- Termination of your employment or authorization with the Client resulting in removal from alert lists.
To the maximum extent permitted by law, Valor Energy Services' total liability arising out of or related to the Service shall not exceed the fees paid by the Client for the specific Service during the three (3) months preceding the claim.
10. Privacy and Data Protection
Collection and use of mobile numbers and related information is governed by our Privacy Policy for SCADA SMS Alert Services, which is incorporated into these Terms by reference. In particular, mobile information is used solely for operational alert delivery and is not shared for marketing or promotional purposes.
11. Modifications to Terms
We may update these Terms from time to time. The "Last Updated" date indicates the current version. Continued receipt of messages after updates constitutes acceptance of the revised Terms. Material changes will be communicated via the Service or through the Client.
12. Governing Law and Contact
These Terms are governed by the laws of the State of North Dakota and applicable U.S. federal law, without regard to conflict of law principles.
